REFUND, RETURN & EXCHANGE POLICY

At The Biasa, we want every order to reach you in the condition and design you expected. Please review this Refund, Return & Exchange Policy carefully before making a purchase.

The Biasa is a brand owned and operated by BEYOND US SDN. BHD. (Registration No. 202301047100 (1541014-T)).

By placing an order through thebiasa.com, you acknowledge and agree to this Policy, subject always to your rights under applicable Malaysian law.

1. CHANGE OF MIND

We do not offer refunds for change-of-mind purchases.

This includes situations where you:

  • no longer want the item;

  • decide that the colour or design does not suit you;

  • change your mind after completing your purchase; or

  • mistakenly purchase the wrong design, colour or quantity.

However, for eligible full-priced items, we may allow a one-time exchange for another design or colour, subject to the conditions below.

2. EXCHANGE FOR A DIFFERENT DESIGN OR COLOUR

If you have selected the wrong design or colour, you may request a one-time exchange within 7 days from the date you receive your order.

All exchanges are:

  • subject to our approval;

  • subject to stock availability;

  • limited to one exchange per eligible item; and

  • subject to the returned item meeting all conditions stated in this Policy.

If the requested replacement item is unavailable, we may offer another available item of equivalent value. A voluntary exchange does not automatically entitle the customer to a cash refund.

Any price difference for a higher-priced replacement item must be paid by the customer. Any treatment of a lower-priced replacement item will be communicated to you before the exchange is confirmed.

For exchanges resulting from customer preference or incorrect selection, the customer is responsible for the cost of returning the item to us and the cost of delivering the replacement item.

Please contact us before returning any item. Items returned without prior approval may not be accepted.

3. CONDITIONS FOR VOLUNTARY EXCHANGES

To qualify for an exchange due to change of colour or design preference, the item must be returned:

  • unworn and unused;

  • unwashed;

  • unaltered;

  • in its original condition;

  • with all original tags and labels attached; and

  • with its original packaging, where applicable.

Returned items must also be free from:

  • makeup or cosmetic marks;

  • perfume, fragrance or other noticeable scents;

  • stains;

  • dirt;

  • damage;

  • signs of wear; or

  • any other condition that would prevent the item from being resold as new.

You may carefully inspect or try on an item in the same manner you reasonably would in a retail store, but it must not be worn for extended use.

We reserve the right to reject a voluntary exchange where the returned item does not meet these conditions.

4. DEFECTIVE, DAMAGED OR INCORRECT ITEMS

If you receive an item that is defective, damaged, incorrect or materially different from what you ordered, please contact us as soon as possible.

For efficient assessment, we ask that you notify us preferably within 7 days of receiving your order.

Please provide:

  • your order number;

  • the name of the affected item;

  • a clear description of the issue; and

  • clear photographs and/or video showing the issue where reasonably possible.

Please do not return the item before contacting us. Our team will review the matter and provide return or other instructions where applicable.

Where the issue is verified, we will provide an appropriate remedy in accordance with the circumstances and applicable Malaysian law. This may include replacement, refund or another appropriate solution.

Where a return is reasonably required because we supplied a defective, damaged or incorrect item, The Biasa will bear or reimburse the reasonable return delivery cost in accordance with the return instructions provided by us.

The 7-day notification period above is intended to help us investigate and resolve issues promptly. It does not exclude or limit any rights or remedies that you may have under applicable Malaysian consumer protection law.

5. WHAT IS NOT GENERALLY CONSIDERED A DEFECT

We make reasonable efforts to display our products as accurately as possible.

However, slight differences may occur due to the nature of photography, digital displays and the production process.

The following are generally not considered defects:

  • slight colour differences caused by lighting, photography, screen settings or display calibration;

  • minor variations in measurements arising from the manufacturing or finishing process; and

  • reasonable variations in the placement of prints, motifs or design elements caused by fabric cutting and production.

This does not apply where the product is materially different from its description or where the variation otherwise amounts to a failure to comply with applicable consumer guarantees.

6. SALE, PROMOTIONAL & FINAL-SALE ITEMS

Unless otherwise expressly stated at the time of purchase, items identified as final sale, clearance items, or items sold under promotions that expressly state they are not exchangeable are not eligible for voluntary change-of-mind returns or exchanges.

This restriction does not apply to rights or remedies that cannot lawfully be excluded, including applicable rights relating to genuinely defective, damaged, incorrect or materially misdescribed goods.

7. RETURN SHIPPING

For an approved voluntary exchange due to customer preference or incorrect selection:

  • return delivery costs are the customer's responsibility;

  • the cost of delivering the replacement item is the customer's responsibility; and

  • original delivery charges, where applicable, are not refundable.

Returned items remain the customer's responsibility until they are received by us. We strongly recommend using a trackable delivery service and retaining proof of postage.

For verified defective, damaged or incorrect items, please follow the return instructions provided by our customer service team before arranging delivery.

We are not responsible for unreasonable or unauthorised return shipping costs incurred without first contacting us, except where otherwise required by applicable law.

8. REFUNDS

Refunds are not provided for ordinary change-of-mind purchases.

Where a refund is approved, we will generally initiate the refund within 7–14 business days after the returned item has been received and, where applicable, inspected.

Approved refunds will generally be made to the original payment method used for the purchase where reasonably practicable.

The time required for the refunded amount to appear in your account may vary depending on your bank, card issuer or payment service provider and is outside our direct control once the refund has been processed by us.

Where a refund to the original payment method is not reasonably possible, we will contact you regarding an appropriate alternative refund method.

9. SHIPPING CHARGES

Original shipping charges are generally non-refundable for voluntary exchanges or change-of-mind matters.

Where a refund or other remedy arises because an item is defective, damaged, incorrect or otherwise fails to comply with applicable consumer guarantees, the treatment of applicable delivery charges will be determined in accordance with the circumstances and applicable Malaysian law.

10. REFUSED, UNCLAIMED OR UNDELIVERABLE PARCELS

Customers are responsible for providing complete and accurate delivery information when placing an order.

If a parcel is returned to us because:

  • an incorrect or incomplete address was provided;

  • the recipient repeatedly could not be reached;

  • the parcel was not collected within the courier's applicable collection period; or

  • delivery was refused without a valid product-related reason,

the customer may be responsible for reasonable additional delivery charges required to resend the order.

Any refund, where applicable, will be assessed after the parcel has been returned to us and subject to this Policy and applicable law.

11. RETURNS OUTSIDE THE VOLUNTARY EXCHANGE PERIOD

We are generally unable to accept voluntary exchange requests made after the applicable 7-day exchange period.

Items sent to us without prior approval may be refused or returned to the customer, and the customer may be responsible for the applicable delivery costs.

This section applies to voluntary exchanges and does not exclude or limit any statutory rights or remedies available under applicable Malaysian law.

12. FAIR USE OF THIS POLICY

We reserve the right to refuse voluntary returns or exchanges where we reasonably identify misuse or abuse of this Policy, including repeated or excessive return activity, items that have been worn or used, fraudulent claims or attempts to return items that were not purchased from The Biasa.

Any decision under this section will be made reasonably and will not affect rights that cannot lawfully be excluded.

13. YOUR RIGHTS UNDER MALAYSIAN LAW

Nothing in this Refund, Return & Exchange Policy is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable Malaysian law.

Where there is any inconsistency between this Policy and a mandatory requirement of applicable law, the applicable legal requirement will prevail.
